Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Binny’s websites, voice services, and related offerings (collectively, the “Service”). By creating an account, linking third-party services, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Agreement

These Terms form a binding agreement between you and Binny. Additional terms or notices may apply to specific features (for example, payment flows); where they conflict with these Terms on a specific point, the feature-specific terms control for that point only.

2. The Service

Binny provides a voice assistant that helps you interact with connected accounts and tools (such as Gmail, Google Calendar, Google Contacts, Slack, and other integrations) over the phone. Features may change over time. We strive for reliable operation but do not guarantee uninterrupted or error-free service.

3. Eligibility and your account

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
• You must provide accurate information when signing up and keep your phone number and linked accounts secure.
• You are responsible for activity that occurs through your Binny account and for complying with applicable laws when you use the Service.
• You must not share credentials or tokens in a way that lets others impersonate you or access your connected data without authorization.

4. Third-party services and Google APIs

The Service relies on third-party platforms (including Google, Slack, telephony providers, and payment processors). Your use of those platforms remains subject to their respective terms and policies. Connecting a third-party account is your choice; you can disconnect integrations from your Binny dashboard where supported.

When you authorize Binny to access Google data (such as Gmail, Calendar, or Contacts), you agree that our access and use of that data will comply with the applicable Google APIs Terms of Service and the policies referenced in our Privacy Policy (including the Google API Services User Data Policy for relevant APIs). You may revoke Binny’s access at any time from your Binny dashboard or your Google Account security settings.

5. Acceptable use

• Do not use the Service to violate law, infringe others’ rights, harass, defraud, or distribute malware.
• Do not attempt to gain unauthorized access to Binny, other users’ data, or third-party systems; do not probe, scan, or test the vulnerability of our systems without written permission.
• Do not misuse voice features to generate harmful, illegal, or abusive content, or to bypass security or rate limits.
• Do not resell, sublicense, or commercially redistribute the Service without our prior written consent.
• We may suspend or terminate access if we reasonably believe you have violated these Terms or pose a risk to the Service or other users.

6. Fees and payments

Some features may require payment (for example, call credits or paid add-ons). Prices, taxes, and billing mechanics will be presented at purchase. Unless required by law or stated otherwise at checkout, fees are non-refundable except as we determine in individual cases. Failure to pay may result in suspension of paid features.

7. Intellectual property

Binny and its licensors own all rights in the Service, including software, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes. You retain rights in content you provide; you grant Binny a license to host, process, and transmit that content only as needed to operate the Service.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THIRD-PARTY INTEGRATIONS WILL ALWAYS BE AVAILABLE OR ACCURATE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BINNY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO BINNY FOR THE SERVICE IN THAT PERIOD OR (B) ONE HUNDRED US DOLLARS (US $100), EXCEPT WHERE PROHIBITED BY LAW.

10. Indemnity

You will defend, indemnify, and hold harmless Binny and its affiliates, officers, employees, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of applicable law or third-party rights.

11. Suspension and termination

We may suspend or terminate your access to the Service at any time for operational, legal, or security reasons, or if you breach these Terms. You may stop using the Service at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

12. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. If changes are material, we will make reasonable efforts to provide additional notice (for example, via the Service or email where available). Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Israel, excluding conflict-of-law rules. Courts in Tel Aviv-Yafo, Israel, will have exclusive jurisdiction over disputes arising from these Terms or the Service, subject to any non-waivable rights you may have under the laws of your country of residence.
